Session 1 - Intellectual Property and Patents, Overview (4 h.)
IP, what are we talking about? The increasing importance of IP for any researcher. Types of protection and their characteristics, examples. Patent: patentable subject matter, eligibility criteria, ownership, protection limits, costs. Relevant information in a patent; Examples. Preliminary analysis of a patent; Examples. Key players in the IP world. Policies and regulations on IP in different organizations. Services and documents (policy and invention declaration document) specific to Polytechnique.
 
Session 2 – Patent Basics (4 h.)
Distinguish between: state of the art and competition; infringement and freedom-to-operate; Criteria for patentability. Preparing an invention declaration: its characteristics; its drafting; calling on an expert; good practices. Policies governing invention declarations at Polytechnique Montréal. Understand the function and meaning of the claims. The scope of a patent. Dependent and independent claims; Examples. Three typical sections: claim, description, drawings; Examples. Main categories of claims; Examples. Evolutions of IP rights: the case of software. Copyright; Examples. Patent; Examples. "Open Source" software: what exactly is it? Examples.
 
Session 3 - Getting Familiar with Patent Searching (4 h.
Why are patents an essential element in a bibliography? How can you find the relevant patents for your work or organization? Databases. Search Modes. Available Information. Search: quick or advanced. Classification. Successfully complete your patent search. Keyword Combinations. Download a patent. Move from keywords to classification code and vice versa. Patent families. Exploit patent links. Set up an automatic alert. Apply the approach to a research project: each participant applies the proposed approach to his or her project or research area in a patent landscape search project. Know how to extract the essential elements of the obtained information.
 
Session 4 – IP Strategy (4 h.)
Obtaining a patent: steps and filing strategies. Differentiate discovery, invention and innovation. Confidentiality. Declaration of Invention. Patentability. The roles of the inventor and the patent agent. Drafting the application. Filing strategies: Patent Cooperation Treaty (PCT)? Publish and patent: it is possible. Responding to the examiner, deadlines. Exploiting patents or those of others: the license. What is a license? The parameters to consider in a license agreement. Simulation of a negotiation between university and company. Competitive intelligence.
 
Homework Project: Preparation of a preliminary patent landscape report relevant to the participant’s field of research.
 
Evaluation: Pass/fail; presence is mandatory.
